Pursuant to art. 7 para. (1) and (2) of Law no. 581/1999 on foundations, the name must obligatorily contain the word “foundation”. If the name of a natural person appears in the foundation’s name, the foundation shall submit to the Public Services Agency that person’s consent regarding the foundation’s name and, if the natural person whose name appears in the foundation’s name is no longer alive — the consent of the spouse, parents and adult children of the deceased person.
It should be noted that art. 9 para. (11) letter c) of Law no. 220/2007 prohibits the registration of a name that contains the name of a well-known natural person or other proper names that do not coincide with the names of the participants in the establishment of the legal entity, unless there is written consent to that effect from the respective person or, as the case may be, from their heirs.
